The 4800 series don't have hardware throttling, it's done in software. The 5800 series is different. The 5970 has a throttling issue, period. It's been noted already by too many professional reviewers. It has nothing to do with prototype hardware, most didn't even receive actual hardware until a few days before launch. They were using retail hardware. Even AMD is blaming heat for the issue.
AMD doesn't need you to try to play damage support, the issue does exist and they're aware of it. However, the card should still perform just fine at stock clocks in normal gaming scenarios, ie...not furmark. Even mild overclocking is acceptable, just not heavy overclocking where a dual 5850 or 5870 setup would be far superior.
