i have both the ps3 and the 360 (ps3 used for $80 and 360 $100 at walmart pre black friday), and on games that i have played both versions or watched some1 live play one and i played the other, on FF13 the ps3 looks way better, on brutal legend there is less lag and dmc4 were the ps3 was less lag the 360 was brighter and had better contrast and the pc was the only playable at a respectable fram rates and image quality.

im not sure what is in the contracts but they should be able to do business with whatever company. it might have to do with licensing r500 intellectual property.
im not sure how it works exactly but xbox reps say that they have exclusive use of ati parts for HD, nintendo stopped the wii from doing HD even though its in the console to run 720p and 1080i, and it makes no sense for sony to use the NV part they saw what NV did to MS with the original xbox with overcharging and reliability problems (problems back then were 5% deaths over the lifetime). the next xbox was announced to have an ati part and the wii is now rumored to have a powerVR for the next one also. so there has to be something with licensing from ati they were used all the time for integrated devices until the qualcom buyout of the ultra mobile, and they dont have a bad name, meaning that powerVR is magic (they are going to be in the apple stuff, android stuff, psp2) so it could be for making things work cross platform but it seams like its the only choice for the full consoles
