DAMMIT ! I said earlier that apparently everything is fine and that I needed to test my oc stability with MCH at +0.2
Well it's not stable with low MCH voltage. I need MCH at +0.3 to be stable wich brings back the PCIEX1 issue. 
I guess it's time to move on to X38. If the F7 bios for P35-DQ6 comes out before I can get my hands on a Maximus Formula I'll give it a go to see if it fixes the PCIE issue otherwise this will be my first and last gigabyte board. Chances are pretty slim though that F7 is going to fix the PCIEX1 issue with high MCH voltage.
I have noticed that both I35Pro and P5K have this option in their bios "FORCE PEG X1" or "FORCE PCIE X1" something like that wich should be set to disabled and it's related to the first PCIEX16 slot. P35-DQ6 doesnt have that option. Sounds to me like it prevents the PCIEX16 slot from being forced back down to X1. Could this be the reason why those two boards dont have this issue P35-DQ6 is having? Just a guess I am not sure.
I have also informed an official gigabyte rep on a forum about this problem in details. IMO it's better than having to jump through low tier bot-like support people to finally reach someone whom you can actually converse with like humans. If you go through requesting official support that is.
