It's working as intended with those settings.
If you want your overclock to be at 4.4Ghz all the time you will need to disable EIST and CPU power saving states, although that kind of defeats the purpose of using adaptive mode.
Also, if you're using Windows 7 or higher, you will need to select the 'high performance' power plan in Windows.
