This was well in the past. They were caught cheating in 3D mark same as Nvidia shortly after. 2001 in the radeon 8500/Geforce 3 series days, ATI was cheating in games, lowering texture quality in the distance which imroved scores and frames but looked ridiculously bad in image quality LOL. shortly after that, Nvidia got into a little dispute with futuremark over the FX launch, Nvidia "appeared" to be cheating in 3Dmark03. Futuremark was claiming that Nvidia/s benches were not representative of real 3D games. There was obviously coding cutting the textures it had to render in half.
Thing is ATI actually cheated TWICE! before Nvidia did with the FX series detonator drivers.
Both companies have done everything in their power to get ahead. So when it comes to this kind of stuff, I could care less. They both cheat, not really anymore though, they dont really need to, both companies are pretty solid atm. Anything nowadays is pretty much an un-expected side effect or looked at the wrong way. ATI has some catching up to do, for shure, though.
If Nvidia says its a bug, I would believe them right now. They obviously have a good distance lead to ATI, atm. Why would they purposely cheat? for fun? These guys are people like us, they make mistakes. Somtimes things (even big) are hugely looked over. Thats what makes these people human, and thats also what betas are for.
sorry for 1000 edits, its kinda my thing.
