I think the point [XC] Oj101 is trying to make is that the important thing here is to get the people who lost money their money back.
Taking someone who has nothing to court will punish Reggie, but will not return much money to those who have lost it if anything. All it will do is damage Reggie's life. (I understand that some people may want that, but at the end of the day it does not accomplish anything.
However, by allowing Reggie to recover there is a chance that later on down the line the debts will be repaid. Even if this is only a partial repayment, I still think that is better than getting nothing back.
I am totally new to this situation..
But to me, it seems that you guys should really wait for Reggie to get your money back. If you take this thing to court, worst thing can happen is for Reggie to declare bankruptcy. That way, you will never get your money back and you guys made his life worse..
For now, just be patient and contact him as best you can. Try too see what he's got to say.

Depends on the method of payment if it was credit card you can do some clame with a bit of help from lawyers but if it was PayPal forget it
