ati deliberately chose to make their dual card <300w. nothing stops manufacturers from making cards that require more power
PCI-SIG consortium does stop manufacturers from making cards above 300w@stock or they don't get PCI-EX certification. I don't think Nvidia would forgo this just to make a faster card.
