For those who are selling their ES CPUs on OCBay, be aware that we will purchase them, and trace back to who ever originally signed up for them.
This is something you don t want to do , I am asking nicely and friendly that this does not happen ... Selling an ES can really get people into trouble, it goes under the laws of "Industrial Espionage :yepp:" and few other nasty stuff you don t want to be cut under. :down:

From stories that goes around I get the idea that most ES's being sold or not CPU's someone has signed for.
from the amount and ease of which you can get ES chips,
I think Intel has to rethink their process of "ES" chip control....
Because they are everywhere.

btw many retail i7 chips read as 'es' in cpuz, in fact all retails i've had have read as 'es' in cpuz, so those chips may not be engineering samples at all.
just my observation.
lets not assume someone is selling es chips because a cpuz screen shows it as that.:up:
How old was the CPU-Z version what you used? i had a lot Core i7 CPUs (or Intel CPUs) and had never a Retail CPU that show as ES in CPU-Z ;)
And btw, i donīt know why so much want a ES. I had hundreds of them (since S478) and all i can say is that the retail CPUs most time clock better :)

It's quite remarkable that when you search for "engineering sample", you'll find one AMD CPU (which may not even be an ES, to my knowledge) - and like 45 auctions with Intel chips.:ROTF:

Who is selling ES chips? i dont think big name websites will sell them. ES i7's suck
What if you end up buying an ES and not knowing it? Is the buyer in trouble, or only when they try to RMA Intel will deny the RMA due to the chip being an ES. This makes me nervous of buying 2nd hand from people with out retail boxes.

I think it's a shame that intel doesn't provide samples to some DC team members. What better proving ground than on rigs that run flat out around the clock?

Why is Intel worried about a trickling of individual ES chips on ebay if www.stalliontek.com sells them by volume everyday and has been for years?
Intel has better things to worry about - like that billion dollar suit in the EU - or the top of the line 3.3ghz Intel quad selling for > $1000 when the AMD 3.2ghz quad is selling for $234...
Besides, it's true - most ES chips after the conroes tended to be crappy overclockers compared to retail and had stupid temp probes that didn't work...

Does anybody know what the difference between 'tray' and 'ES' CPUs? lagoom.com has been selling 'tray' CPUs for some time now and these don't come with retail box just the CPU and they have only 30-day warranty from lagoom.com and nothing from Intel. Does that sound fishy? It looks like 'tray' is same as 'ES' because if these were OEM, they would still carry 3-yr Intel warranty.

I hope you guys see the paradox, in one hand, you are asking for samples , as a community, but in the other hand, inside this community, there are people selling what they got for free, and got it from somebody who did not respect his engagement (NDA) about this samples ... As long as people inside the OC community do this traffic, it is fairly hard to considere the OC community seriously for sampling ... Just sit in my place, and look at the problem from there.
People are trying to make money of something they don't own, if you pay for a Sample, I can repossese it anytime. They are just borrowed part and are always the property of Intel.
I am not trying to blame anybody here, But understand that the team of F1 don't go and steel and sell the engines of Mercedes or Renault ... If you want to be treated as a serious sport, It has to go by not doing nasty stuffs in the league. This start by excluding ES from the competitions, too often, I see top overclockers bragging about their ES they got under covers ... This is not a sign of an Healthy Overclocker, but more a sign of Mafia ... ;-)
I hope you guys understand that I am trying to help the OC community to become a more serious organization, through all of those advise.
To conclude, Yes, we do purchase often ES Chips, and yes, some people get in trouble, and every time, I am like "Dude! What was you thinking!!!"

Technically and legally Intel does retain ownership of all ES chips they send out to manufacturers of boards,etc.

I've had a bunch of ES CPU's, but I'd never sell one, or buy one, for that matter. When I have one I don't need, I simply loan it to a friend, so I can return it to Intel when/if they want it back. It might end up being costly selling one of those.

I think he's just trying to give fair warning to people who might get caught up in a mess. It's really not worth hunting for those. Community binned retail is the best anyway. That's the beauty of the forums sharing all the results from different retail cpus can show the gems.

Guys intel ES's are always property of Intel. And its not really up to you guys to complain, because intel gives the cpu's out under there conditions, not yours.
If you bought one, and most of you probably dont know where the chip came from, then good for you, you just got the chip illegally, and if the vendor ever asks for it back, you will likely screw him.

I actually have 2 ES chips obtained by legit avenues I will always honor my agreement.
You can and will find many ES chips on ebay for sure, there is a guy from Vancouver Canada who sells them all the time and posts in his ad that he can legally sell them, once you quote the NDA agreement he never replies. I do not support the selling of ES chips but it wont stop its ppl's nature to profit
Here's hoping the Q9650 I just bought on ebay isn't an ES...if it ever arrives. :mad: It was Ģ125 - very good, or too good to be true? The seller has since sold another one, so the ES theory at least explains why he's prepared to let them go for so little when most preowned Q9650s are going around the Ģ200 mark. :shrugs:

I've asked many times politely but never even got an answer, maybe you could star by reviewing who do you give the samples to and i never even asked it for personal reasons.
I'm one of the owners of the biggest hardware review website in spanish (3 million unique IPs a month) so we do tons of testing, support in our forums, work with motherboard companies, memory companies etc... and nothing.
So yes from time to time we have had to buy a couple of ES (not only Intel).

I guess this is the best place to post this question as people who are knowledgeable on the topic will be reading this thread (a bit OT sorry): I have an AA (pre-release) AMD 955be that I won in a contest - when the time comes for me to sell it and go to a newer model can I sell it on the forums or is it too under ES restriction?

As I said in an earlier post I think the issue is not one or even 100 guys getting a ES cpu from some contact in some company but more the sale of large volumes of ES chips.
Es chips have always been around to those with the right contacts and always will.
That's not the issue, selling in big quanties is and is perceived by Intel as cutting into their bottom line.
Like all else in life money is what causes this question to surface here.
Intel is trying to protect their bottom line and I can't blame them for doing so.
My concerns is are there any specific reason why DrWho? started the thread here? Did he found someone selling ES chips in huge quanitites here? As far as i know, we don't even allow selling ES chips in the FS/FT section. So why???

check who sends how many ES chips where and verify whether they are actually still in place or what happened to them.
i heard rumors of intel employees handing over large amounts of ES chips as a favour to intel partners, knowing that they will use them in systems or sell them and that this is an extra income for them... not sure how true this is, but im sure this rumor is based on some truth at least...
i heard both scenarios:
A: Intel employee hands over ES chips to a friend from an intel partner company as a thank you for cooperation or sign of good will or to return a previous favour, whatever... the friend from the intel partner company then sells them or uses them in systems (dell repeatedly did this for example, and there were hundreds to thousands of cpus involved)
to intel those chips pretty much cost 50$ each, but to everybody else they are worth hundreds of dollars... intel and other chip companies are pretty much printing their own money. and francois, i know your a nice guy and all intel people you know, well probably most, are very decent people... but you cant deny that there are black sheeps at intel just as at any company, and when you are under pressure to win a deal and have chips available that are almost free for you and worth 10X their weight in gold to your customers... thats one way of bribing them, a smart way, cause it doesnt really leave notable traces...
B: intel employee isnt happy with his salary, but he has access to ES chips... people are willing to pay a lot of money for them, and as long as they arent sold to the competition directly the moral barrier isnt a real problem for most people in such a situation, so off the chips go, and up the employees account balance goes :D
