Ok my panic is over... my temps are just fine. I'm reviewing the pics from pcCI2Minimal.
So... Let's add this factors...
My settings:
10x400 @ 1.4V.
On Idle I'm sitting around 36C perfect.
On Load: I'm getting 75C tops while stressing 4 cores Prime 95
That's 25C to Tjunction remaining.
This is kind of what it was achieved by pcCI2Minimal @ 4100, but with extra factors to consider.
-Thermalright Ultra-120 Extreme, Lapped Mirror finish.
-Arctic Silver 5 paste.
-Most important Case doors of my P182 enclosure closed.
-120mm CPU and exhaust fan undervolted @ 1024RPM, I'm not running my fans full speed, I like silence.
-And on top of that to make things worse, I have a 8800Ultra Overclocked inside that case. ( a freaking furnace), in my experience from switching my former GPU to this one it adds 5-7C more to the CPU temp.
-And finally Ambient temp of 75F = 23C
The run on air that pcCI2Minimal , if I'm not wrong and for the pictures I see it was done with the motherboard outside the case in the air and the stock cooler.
I've rechecked and re-installed my TRUE 120 and AS5 paste again. (Also note I have the coin/washer mod made on this cooler). There could be absolutely nothing wrong.
So now you have it, for the ones interested that's the test inside a case with a Thermalright 120 Extreme.

Well my friend I know what is wrong with your temps,the fan speed is to low ,why not a try on full speed?

I can push a bit more on air (4250mhz-4300mhz ,1.5v - 1.55v maybe).
well I am a little crazy but not a killer and 1.45v will be the top voltage for air(24/7)
Its only a small review
well, I can not handle these clocks @ 24/7 ,not on air and I hate water so I expect 4.0ghz - 4.1ghz on a good and quiet air.

btw, we should really get passed the tale that ES are always the best, its not true. Right now some of the best Fsb cpus for qx6850 G0 are retail
later batches and not ES....;)
L739Axxx are very good overclockers.
Its all luck of the cpu you get and
skill of the overclocker to get that cpu going.....
why do you think guys test 10 cpus for ?
so when review/bench with the best one out of the 10.
Its not as easy as it sounds going through so many cpus to find the magic one,
whether ES or retail.....you still have to test many for it to be actually be cherry picked....
not all ES are cherries......

Fantastic job on air,man you have some bawlls to give it 1.7V+ on aircooling, i've never even done that with my 65nm Conroe on water but as long as your temps are fine, why not?

Oscar your results arent too bad, just because Criminal had certain results does not mean you should expect the same thing. Read the other 9650 thread a guy has his @ 4.2Ghz prime stable but its with watercooling

Also this chips are blessed. I've tried it at stock speeds but with a VCORE of 1.25. They are f...ing COLD 25C Idle 46C on Load. :-) I've just found out this one sits nicely at those voltages.

he will probably not answer since he is a very busy xtreme overclocker visiting many forums to post his findings....you, sir, are on your own!...just read in many forums to find out what's going on with this chip.
remember, boards are different even from the same mobo maker...hardware affects ouput results...he just about uses extreme for everything including extreme output fans to cool "ALL" aspects of the board, except for his opening page of this thread...i've seen a film clip on youtube showing him using a SAN ACE screaming fan mounted on the older Intel model cooler; for most of us, the San Ace would be unacceptable because of the produced noise.

It may just be the oem 9650 that I got, but it doesn't appear to me that there is a huge difference between good air and single phase in terms of stable overclocking of these. I still haven't found the exact top end of mine here, but it seems like it is somewhere in the 4800mhz area. And that needs 1.55 volts. (this is on a p5k dlx and ddr2 setup) That's not much higher than some of these air results. Actually this was somewhat similar in the QX6850 to some extent from my experience. I would have expected alot more, but I guess when your overclock a cpu from 3 ghz to 4.4 on air, that's already close to the limit of the cpu short of liq nitrogen, or multi stage phase cooling. Not that there is anything to complain about 4800, but with those super high air results, it seems like there would be more headroom. Again, maybe it's just my part. I did have it posting in windows at 49xx on a P5E3 board with 4GB ddr3 before the MB went belly up, but the phase evap head mount wasn't making full contact and it wasn't stable.
I also wanted to mention that high fsb on this 45nm one seems much harder to achive than on my QX6850. I see another user reporting the same here:

you are just about scaling as would be expected...you had about 4400+ with your QX6850 and most people were getting around 3.9-4Ghz on air...so...about 400-500 Mhz increase if you use phase sounds about right...maybe a bios tweak by asus will get you a little bit more.

Apparently it is possible to get 4Ghz on this thing on air with VCORES lower than 1.4.
Also I did notice that it is possible to run this chip at stock 3.00Ghz STABLE with only 0.992VCORE.
PcCI2iminal - looks like got a similar batch number as yours just off by one
