i'll try this bios on lunch here in about 15 minutes and report back.
gigabyte has denied any wrong doing by putting the majority of the hardware on 2 IRQ's so that right there,they fell back down the technical latter when they said that to me. thats just idiotic.
anyways im happy to test and let everyone know.

410 in the bios bootable. but no higher. 415 via windows and im out of time gotta head back to work.

New bios hasn't done nothing for me:( looks like i am going to have to wait a little longer for the bigger overclock
only thing i saw physically int he bios was the addition of the cpuid lock at 3. for legacy os's.
or have i just not payed any attention to that from the F3 bios.
i hit 410 then the system would reboot and NOT turn off this time it would just cycle the pre-post stages where your cdrom's cycle. but thats all.
so ill have to reset the cmos tonight when i get home. which entails swpaping ram out.
but my ocz stuff showed up so ill swap with that and see how well it does.
as for anything else, i imagine it was just some slight issues resolved.
i will have to reload to check the IRQ situation i believe.
which i dont mind,
give me a chance to set raid again to check the PIO mode thingy also.
