Apple wins trial against Samsung, is awarded 1 billion $

Dear lord. The jury appears to be full of idiots. They took about 2 minutes for each point. Did they discuss prior art at all? Hardly a controversial discussion

The patent system in the US of A is FUBAR.

700 questions to answer by the 9 jury... 1st one was where is my new shiny iphone 5... funny the judge ruled the galaxy tab did infringe on the ipad earlier in the year, but this jury said no to that? judge is a idiot. samsung should just stop supply of hardware to apple, and move out of the US market.. apple would lose more than a billion not being able to fill orders... samsung would still get hurt in the pocket too but alot less this way...

I don't think they're idiots.. That was expected, the original samsung galaxy was made to feel and work like an iphone, so no surprises here.

They can't break any existing contracts - and if Samsung can make money from an apple selling an iphone rather than say LG, why not.

Medium term I'm wondering if Apple will make the jump to Intel CPU on the mobile side, Intel would likely give an extremely good deal to help establish their offering for phones.

I'm quite shocked and surprised at the final verdict, I was expecting Apple to lose.

but its also financial fraud. which can cause the judge to loose his bar. if the Samsung product was selling for less and/or people who refuse to buy apple product bought these Samsung phones.
since there is then no proof of loss to apple. since those sales were never gonna be iphone sales.
when a judge makes a wrong ruling and is caught and confronted on it. the judge looses his bar to the party they ruled wrongly against.
bar is their bond , their insurance , which gave them their power to practice law. without this bond, they cannot be a judge, cause they're not putting up any collateral to give them power.
the average small town judge has a 50 million dollar bond.
atleast this is how it works in countries where rule of law exists.
cause no matter what the jury decides it still comes down to the judges ruling. if the ruling was not fair, impartial and non bias. and has evidence that apple actually lost this 1 billion dollars. then its fraud.
and if this judges ruling was financial fraud causing loss to any ones quality of life. then its in violation of common law 3 and a criminal offence.

reading the jury findings shows exactly how stupid they were.

i bet that no one would mistake the samsung phone for an iphone, but somehow its infringing. probably because every member on the jury things that if it looks similar then its infringement.

one of the best points was that apple is using patents that have been around for decades and so have other companies. its only recently that problems started where one company decided to just hate on the rest.

Smartphones / Tablets / Digital Picture Frames / TVs / Monitors and so on are all designed for the same thing, to display info and usually sport a rectangular display area and a frame around it, kind of like this did more than 100 years ago:

    x5cmxg.jpg

I took the liberty to mark the display area in red and the frame in green, note the rectangular shape of both, just like a modern day Smartphone / Tablet / Digital Picture Frame / TV / Monitor.

lets not forget. that the new trusted tool for knowledge's. the widescreen TV. also shares an un-canny resemblance to the shape and intended purpose of the bible. of which is 4000 years older and it too was about telling the story and spreading the knowledge.

And on the topic of the bible, what fruit did Adam and Eve eat that they where not supposed to? wasn't that an Apple? Now look at the Apple logo, blatant rip off right there. As according to the bible they where the first humans which means everyone is a descendant from those two, does that mean the entire world population can now file a class action lawsuit against apple?

I can haz infinity trillion $ now?

if adam didn't sound like atom and eve didn't sound like eLe and rib wasn't so close to RIP. and BC didn't sound like because and ad didn't sound like all dieing . and the new age wasn't about ae all extinct if it didn't write it as all die and we get heaven.
damn that bible had it right. don't eat tree fruit, don't gluttony (dairy) , even hitch hikers guide to the galaxy was right, 42 is the meaning of life the universe and everything, april 2011, 2012th year, when fallout reaches the usa dairy supply.

but i guess that doesn't fit the topic as well. oh well.

The next time you miss the point of what I wanted to say, do it less graphically... Samsung's engineers directly compared an s1 with an ihone and wrote 132 pages of recommendations how various things on the former should be more like on the latter. In that document even the engineers themselves recognised the visual likeness of both phones.

Can you imagine tire companies sueing each other because the competitor's product is black and rounded?

    This is what happened.

personally, if i was Samsung, i will stop prodcuts the Iphone 5 the Ipad 3 and i will just put all their Frand patent, including broadband 3-4g patents on the trash.... without samsung the Iphone cant even send a sms or be connected to internet..
In reality without Samsung, ARM processors will not even exist... you think TSMC can provide enough chips to Apple ? well we know all how it have end for Qualcom Snapdragon S4 .

Its an Android site but they do make a good point.

I think that cases like these should be judged upon by a jury of experts and not normal ordinary people from the region.
