FlamingBlade "AHCI Bios not installed" error

Hello ppls, I have a foxconn flaming blade motherboard, bought it for a Xeon X5670 witch is supported only by last bios, so i have put in a Xeon E5502 and flashed the bios to P09 but now i get a wierd error "AHCI Bios not installed" and every time when i start the comp i must do a clear cmos cuz if it don't it stops at "A1" post (onboard diagnostic led).

Flashed the bios multiple times with P09 and G21 using different options and no success.

Is there any solution to this or i must return the motherboard?
