Thursday last week OCTeamDenmark received a legal warning stating that the site name www.OCTeamDenmark.Com was a violation of TeamDanmark´s name patent.TeamDanmark with an A is the national agency, with support from the danish tax payers, promote Danish Elite Sports. TeamDanmark wants OCTeamDenmark.Com to change site name to OCTeamDK, stop promoting the site as OCTeamDenmark, change mail adresses and everything, if not legal actions will be taken and damages to the name TeamDanmark will be demanded via the Danish courts.
Zacco, the law firm representing TeamDanmark demanded an answer withing 8 days. After speaking directly to TeamDanmark, their communications employee and their internal lawyer we learned that nobody at TeamDanmark was aware of this case.This indicates that TeamDanmark lets their law firm Zacco hunt whom ever they want, threaten them into giving up their Site/Url name and by doing so avoiding to the deal with the authority´s about their issue.
In Denmark there is a government approved agency that deals with these kind of problems. But going there as a first, would decrease their chance of suppressing the other party. Since this is a .Com website they have to complain to icann.org and not the danish civil courts. It appears threats is the way the proude TeamDanmark has chosen.
Even a mail to the president of TeamDanmark dident deserve a reply.
An explanation regarding why OCTeamDenmark was chosen and how all Overclocking teams pick their names, OCTeamCountryname was what the inhouse lawer at TeamDanmark adviced us to explain to Zacco´s lawyer Christain L. Bardenfleth. Even the internal layers at TeamDanmark cant understand the law suite.
This was not acceptable, and a final attempt was made yesterday by me to convince the Director, The PR manager and the in House lawyer at TeamDanmark that this was wrong.
That we here at OCTeamDenmark only try and promote Danish overclocking, that we don't earn any money providing Overclocking support to Danes and all other nations, and that our work cant have any conflict what so ever with their name.
What we do, has nothing to do with what they do, and that NOBODY has ever thought OCTeamDenmark.Com was a part of the goverment agency TeamDanmark.dk was futile.
I, Nosfer@tu - Peter Kirk, a Simple trainee that don't make a lot of money have only tried to promote my country. Promote Danish overclockers.
Therefore it is with regret we are forced to publish this because we fell it is damaging to the danish reputation...
WE WILL FIGHT THIS.....
We had 2 choises. Do as told or try and figth it.
We have spent almost 2 years working to promote our name and danish overclockers, so chaning site name and abandenin to promote our selfs as OCTeamDenmark was not an option I liked.
We decided that we would give them a figth and try and produce as much PR about this problem as we could. I dont like to write these things, because I think this is counterproductive to what we have been working for so long.
Things like this does not give a understandable picture of our small country....
