It's quite remarkable that when you search for "engineering sample", you'll find one AMD CPU (which may not even be an ES, to my knowledge) - and like 45 auctions with Intel chips.:ROTF:

it's prob just some reverse intel logic, they haven't been selling to good
so now people will buy them to check them out.
Becouse everybody that buys ES is after Intels big secret.

Who is selling ES chips? i dont think big name websites will sell them. ES i7's suck
What if you end up buying an ES and not knowing it? Is the buyer in trouble, or only when they try to RMA Intel will deny the RMA due to the chip being an ES. This makes me nervous of buying 2nd hand from people with out retail boxes.

You cant sell ES's here, nor can u sell them on Techpowerup, i believe hardforums also prohibits them, and on anandtech its treading a very very gray line.

I think it's a shame that intel doesn't provide samples to some DC team members. What better proving ground than on rigs that run flat out around the clock?
so what is one to do with an ES chip if has no use anymore, the testing and reviews have been done and the chip entered production?
is there a time frame where a sale is forbidden?
can the chip be returned to intel for a refund if at all it was paid for?
most important, how can i get my hands on an ES?

Why is Intel worried about a trickling of individual ES chips on ebay if www.stalliontek.com sells them by volume everyday and has been for years?
Intel has better things to worry about - like that billion dollar suit in the EU - or the top of the line 3.3ghz Intel quad selling for > $1000 when the AMD 3.2ghz quad is selling for $234...
Besides, it's true - most ES chips after the conroes tended to be crappy overclockers compared to retail and had stupid temp probes that didn't work...

Does anybody know what the difference between 'tray' and 'ES' CPUs? lagoom.com has been selling 'tray' CPUs for some time now and these don't come with retail box just the CPU and they have only 30-day warranty from lagoom.com and nothing from Intel. Does that sound fishy? It looks like 'tray' is same as 'ES' because if these were OEM, they would still carry 3-yr Intel warranty.
If someone provides Intel with proof that they bought from lagoom.com, will they sue lagoom.com or honor the (non-existent) warranty and RMA the chip? DrWho, any inputs?
I hope you guys see the paradox, in one hand, you are asking for samples , as a community, but in the other hand, inside this community, there are people selling what they got for free, and got it from somebody who did not respect his engagement (NDA) about this samples ... As long as people inside the OC community do this traffic, it is fairly hard to considere the OC community seriously for sampling ... Just sit in my place, and look at the problem from there.
People are trying to make money of something they don't own, if you pay for a Sample, I can repossese it anytime. They are just borrowed part and are always the property of Intel.
I am not trying to blame anybody here, But understand that the team of F1 don't go and steel and sell the engines of Mercedes or Renault ... If you want to be treated as a serious sport, It has to go by not doing nasty stuffs in the league. This start by excluding ES from the competitions, too often, I see top overclockers bragging about their ES they got under covers ... This is not a sign of an Healthy Overclocker, but more a sign of Mafia ... ;-)
I hope you guys understand that I am trying to help the OC community to become a more serious organization, through all of those advise.
To conclude, Yes, we do purchase often ES Chips, and yes, some people get in trouble, and every time, I am like "Dude! What was you thinking!!!"

Technically and legally Intel does retain ownership of all ES chips they send out to manufacturers of boards,etc.
Don't flame him for the post, thank him for letting you know before you get yourself into any problems.

I've had a bunch of ES CPU's, but I'd never sell one, or buy one, for that matter. When I have one I don't need, I simply loan it to a friend, so I can return it to Intel when/if they want it back. It might end up being costly selling one of those.
