We at WCUK have stopped trading with Aqutuning as a result of their back-stabbing antics and we are in correspondace with the other companies involved to ensure the correct outcome.
To say you were 99.8% sure proves your "sources" can't be all they're cracked up to be, until now we've made abosuletly zero public comments on this issue.
The Feser issue was totally un-related to this Aquatuning farse.

not sure I like the way this thread is drifting now...there was an issue, a big issue that needed to be commented, but let's not go into each company's internal policies and bring up all the dirt on XS. Time to lock this thread I would say.
I mailed our Atuning contact about this, if he already replies that would be something :p Getting any waterblocks that would be an even bigger miracle...

Sorry, did anyone read or can really prove that the concerned companies do disagree with the procedure of Aquatuning?
The rumors are online several days, but I have not read any real confirmation, yet ...
Only a "I have heard" or "XYZ will take legal action", but no assured facts. Are you really really really sure, that Aquatuning did not act within the limits of their contracts as a (local exculsive) distributor?

I have contacted most of the manufacturers. Those who have responded were not aware of this activity, did not authorize this activity, did not approve of this activity, and are actively taking legal action to combat this activity.
I will not post their responses here because I don't feel I have the right to post their email correspondences.

If you don't believe those who have posted that they have been in contact with the companies involved (and even one who posted here who is directly involved) then contact the companies yourself and ask for comment so that you can make an informed decision about whether or not to support this company. If AT had nothing to hide, they would have explained the situation by now instead of declining to comment and allowing this to perpetuate.
confirming, I've also been in touch with two companies I won't name there, one said they were aware of the issue for a while, the other one is taking action and thanked me for the friendly warning ;)
I had a real live face-to-face conversation with one of the parties about it and they were NOT happy. Then I read from a couple others posting on OTHER forums that have a big issue with it. So WTF are you saying? AQUATUNING DID NOT HAVE PERMISSION to do so. Tell me how you are connected to Aquatuning? Only someone connected would defend them.
you must be kidding, I for one and others here too I'm sure use to consider Aquatuning as the best liquid cooling gear provider in Europe; so how any of us would have any sort of interest in initiating a campaign against them for some obscure reason :shrug: It does bother me that Aquatuning is involved in that mess, and I certainly would have preferred the rumors to be unfounded, but they're unfortunately not. Simple answer, they didn't react before because they didn't know before. It is not the job of the trademark registry to contact all possible people being infringed upon. It is the job of the registrant to make sure, and it is the job of proper parties involved to make sure they protect their trademarks. In this case AT is primarily snapping up trademarks of companies products who are based overseas.
Have you registered your companies trademarks in China, Japan, Korea, Australia, United States, Russia, Germany, France, England, etc.... ?
I know that at least most of the companies in question have their trademarks registered in their home countries.
It costs a lot of money, and isn't necessarily worth it. If you would have read the thread you would have seen that we have all come to the conclusion that LEGALLY there might not technically be anything wrong with what AT is doing. However, there is a 6 month dispute period where the companies effected can dispute the trademark registration.
Irregardless of the legality of the matter, the morals and ethics are simply despicable. That is primarily what most of us are objecting to. The general behavior at play here. It's like those seedy personal injury lawyers who chase ambulances around town. Nobody really likes their behavior even though it is within the law.
How do you think people would react if I trademarked AquaComputer in the United States (open trademark btw) and then started demanding royalty fees for every aquatube, aquaero or AC product sold in the United States. Legally I could do that, but it doesn't mean that people have to like it or approve of it.
The really sucky part is that the companies who now have to defend their trademarks with lawyers are going to lose a lot of money and it'll more than likely get pawned off on us with higher component prices.

I've been trying all day to reconfigure my watercooling parts purchase to avoid Aquatuning. What they're doing is the lowest of low.
I even ended up buying my new Enermax 85+ 1250 from another site for 18 Euros more just to give Aquatuning the finger. I'm voting with my wallet.

A multi-national like St Gobain, who deals in thermoplastics, and therefore must have close ties with oil multi-nationals, seems like the kind of people that can sort minor issues like this with a phone call and at administrative level, without actually having to bother the board of directors with minutia :D
Still, if AT is really trying to register all these trademarks as their own, I really don't know what they think they're gonna achieve.

there is no "public" reaction from those companies against AT because this is likely going to the courts, and all information will NOT be released to the public. that is why u dont see Gabe or other company reps in here posting their plans.

Well I signed up yesterday and ordered some new EK blocks and stuff from the UK store - they have the best range of items and most in stock, plus Free delivery (with a Ģ4 handling fee) for UPS to UK.
I am a consumer not a manufacturer - I may not agree with what they have allegedly done but if companies do not register there marks in Europe then I suppose anyone could do so ..........
So, I guess your point is that it's all right for a small company to produce a product in one particular country, become somewhat successful, trademark the name of their company in their country, and yet be held hostage to anyone in Nigeria, Yemen, Germany, wherever, that decides to "trademark" the name that was established with their hard work, simply because that company neglected to run around to all 156 countries around the world spending upwards of $3K or more per country to trademark that name?
So, in that vein, please go invent and market something. I'll immediately copy your trademark and trademark it for myself in Bermuda or Indonesia, get it made cheaper in China, and steal your market.......
Sounds stupid, but that's essentially what Aquatunig is doing. Do you think Swiftech, a rather small company, has the financial resources to trademark each country individually at a cost of possibly $1M? I'd rather think countries would honor trademarks across the world just like patents are done or copyrights are done.
In fact, I think Aquatuning can actually be taken down with copyright infringement, since once the name is trademarked it's also copyrighted and we all know how copyright is heavy-handed enforced around the world.

I said that I didn't agree with what they are alleged to have done but looking at their site, I don't see them selling other companies products as their own .... if you look at their "own name" section it is simply bits and pieces still carrying the original makers name .......
man, this is absolutely not the issue at all; nobody said they would attempt to sell stuff under their own name :rolleyes: Registering trademarks for them means they could simply sue any other retailer selling the same products, nice hey :D (and this could also include the manufacturers themselves when they sell directly, or when they have a contract with someone else than AT).
Guys lets not get into grief with each other. Everyone has the right to buy from where ever they like and we should not be against that nor should we be resentful/hateful towards that person/s.
Obviously there are facts, speculations and here says in this scenario with AT. Lets all continue to get along and seek more factual information and I'm sure as this "A-T GATE" becomes clear and translucent, we will all do the right thing and give our support and backing to those who deserve it.
I personally do not call for a boycott of AT ;) Legal actions taken by the respective concerned brand owners is the way, whatever the outcome is. That doesn't mean that I'd advise anyone to keep buying there, everybody is free.

On the other hand enough evidence have been presented to put a dent in AT creditability and at least I would be hesitant to buy something from AT at the moment.
Below is some info regarding trademark laws. It's not as cut and dry as registering a name, then arbitrarily suing companies who use it. Such an environment would be impossible to do business in.

It's sort of like finding a burglar in your house. Then saying he hasn't committed any crimes, he was only allegedly burglarizing your house. They got their hand caught in the cookie jar ... who cares if they have actually taken a cookie out yet?

I never said what AQ's motive was. The move was insanely stupid and they will feel a severe impact. At the end of the day that is all that matters. I am positive they are very sorry that made this misstep. They have lost a lot of customers and most likely suppliers as well.

Personally I have decided that aquatuning should go burn in hell, they won't get any money from me anymore.

You think we need AT to get LC gear in France, in the UK, in the Nehterlands, and even in Germany ??? NO. AT is one possible provider, just an online retailer, just that and nothing more. AT could disappear from the surface of the earth and XS would keep rolling with new builds as usual, made with components bought legally all over the globe OK ?
Again, as I just said in a post above, the aim for AT has never been to sell components under their own name, but to trademark those components in order to be able to sue anyone else selling them too.

Well, since you are so "in the know" with Aquatuning, then I wouldn't think it'd be hard to show these "exclusive" contracts AT has with Swiftech, D-Tek, Danger Den, et al.
In fact, I'd have thought that'd be the first thing AT produced on their forum and in others where this issue has been brought up.
Instead, we get stonewalling and no answers from the company in question....and I seriously doubt AT could produce these "exclusive" contracts if they had to.

Seems to me that AquaTunings "spindoctoring" position here is that if the companies don't "complain" it's perfectly ok for AT to do something that any reasoning human being would see as highly unethical?
The ONLY thing I could see to justify what AT is doing is if this was done "in ageement and upon the request of the companies who's names have been trademarked. Since NOTHING to this affect has been shown, it's pretty clear that AT is doing this in order to corner the market in those regions in a HIGHLY unethical manner.

They just opened a support thread in Germany (LUXX) and maybe they will open one here too if you ask there. They were very quick with the german one, so maybe you can ask to open one here too. Then you could discuss the issues with them directly. As they are such a big global company now, I bet they would do that here very quick too.
I just confirmed with DD they have not had a contract with AT since last Summer and AT did not have their permission. They also have been in contact with their competitors who also have said they did not give AT permission. Lawyers are involved who are familiar with the clown who caused this as they dealt with him when he pulled the same crap with the Blace Ice branding.
Don't worry - it was meant ironically at the moment, I don't like that "global dominator" blowup either now that I have read the story and see no actions. :)

The best thing to do would be to wait for the big boys to finally speak out and perhaps stop buying anything from *ahem* until this whole mess clears up. Becos if they have a barrage of potential lawsuits coming up, and their pants get sued off them, they may just disappear off the radar...before shipping out the orders...
