View Full Version : Apple ordered to run Samsung 'did not copy iPad' adverts

A UK judge has ordered Apple to publish announcements that Samsung did not copy the design of its iPad, according to the Bloomberg news agency.

It said the judge said one notice should remain on Apple's website for at least six months, while other adverts should be placed in various newspapers and magazines.

It follows the US company's failed attempt to block sales of the South Korean firm's Galaxy Tab tablets.

Apple has not commented on the news.

So if the Judge ruled this way because the Galaxy Tab is not as cool* as the iPad, does that mean Apple now has a patent on cool* and Apple will now take every product to court that is seen as cool* by someone?

*cool is a registered trademark of Apple, all rights reserved.

Samsung did not copy us, they were simply inspired by the perfection which is the new iPad 3. Orders yours today.

i wonder if the ruling stated something along the lines that they can't twist the advertisements / statements around to seem like that.

Probably not but UK judges have a nice habit of calling companies/people back in to make the punishment worse if they attempt to work around judgements. If Apple try to use it to gain sales he can apply fines, block sales, including Itunes sales etc.

Nah...Apple will just conveniently "forget" a billion or two at the EU headquarters...especially with things looking not so rosy financially in Europe.

For all intents and purposes, it would be a bribe, but Apple has the best spin doctors in the world...they could paint a pretty picture how the money is going to provide hope for the suffering masses in Europe...:D. A nice generous contribution to the IMF in their current time of considerable need would go a long way toward softening the stance that is forming up against them.

Money talks and Apple has it in abundance...;)

I am sorry to say that the IMF could not care less what Apple does. Neither does the ECB. Economically speaking anything under 50bn dollars is kind of insignificant for these financial institutions.

Now, samsung putting samsung OS into samsungs products/hardware.
(Samsung got all chip infos on samsung hardware, io and memory maped units.)

It's funny you say that, when the IMF is going around from country to country in the G20 with it's hat in hand canvassing for donations. Then they get all pissy when some countries turn them down. Apple couldn't resolve the issue by themselves, but a few billion would probably buy them a little leeway.

ahhh IMF is made up of countries who gain membership by contributing portions of their GDP's and a percentage of voting power in "relative" proportion to their output (also known as Y, or GDP) as well as a few caveats they are allowed to meet. All in all, we all know apple had money, however this was not part of the thread, is kinda business-politics heavy, and no there is no way in the world you can compare a country (actually called state's) GDP with the "projected" value of a company. Always rememebr that a company's valuation does not mean how much they have in the bank to throw around.



This is so out of topic I will not mind if the Admins like Diltech of Dave earase my post, since I dislike talking about this sorta crap in a tech forum.

Only the 7.7 ... lol the judge think it look more like the Ipad and not the 10.1 ( the 10.1 is not touch by this ) .. The story is a bit complicate as Deutshland is part of EBV court who is the european brevet court (something like that ). But it is only the decision of this judge .... actually Samsung will surely push further and ask to remove this ban to the initial authority .

( the image are strangely at the same size, one come from Samsung site and the other from Apple site ( one is a 7.7" tablet and extremly long the ipad is ofc a 9" obviously close to a square, one is made for be keep in one hand and the other you can try if you have big hands . )

Design patents that patent "looks" or patents that patent something like swipe should be denied and invalidated, if round corners and clean look can be patented it will only cause harm to competition and restricts innovation.
I could patent round corner and i could kill apple by saying "apple is using my patent without my authorization" and block apple out of market.

Its a bit more complicate, without enter the details, you put some "points of value " in the design patent, if you attack someone thoses point should be compared... for the example, in UK and some other country where Apple have attack Samsung on the design, the judge have find at least 55 pnts in the design of Samsung who differentiate the Galaxy Tab from the Ipad.. so he cant conclude to a copy of the Apple design.. what is really strange, is in Deutshland the judge seems have absolutely not work like that and just follow the " square with a screen " claim from Apple .

Most tablets look very similar, lets face it, essentially the design is almost always rectangular touchscreen in metal / plastic enclosure with no extra physical bits on the outside, exceptions? Sony P, Asus EeePad Slider & Transformer. Which makes it questionable how a court can justify a ban on one specific model of the look a like standard tablets.
